Welcome to Grind & Grow, a platform connecting local service providers ("Vendors") with customers seeking their services ("Customers"). By accessing or using our website, mobile application, or services (collectively, the "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use the Platform.

1. General Terms

1.1 Acceptance of Terms: These Terms govern your use of the Grind & Grow Platform. By registering, accessing, or using the Platform, you confirm you are at least 18 years old and agree to comply with these Terms.

1.2 Changes to Terms: Grind & Grow reserves the right to modify these Terms at any time. Updated Terms will be posted on the Platform with the effective date. Continued use of the Platform constitutes acceptance of the revised Terms.

1.3 Eligibility: The Platform is available only to individuals and businesses legally permitted to enter contracts in their jurisdiction. By using the Platform, you represent that you meet these requirements.

2. Platform Use

2.1 Purpose: Grind & Grow connects Vendors offering services (e.g., plumbing, hair styling, photography) with Customers seeking those services in their local community.

2.2 User Accounts:

Vendors: To join as a Vendor, you must pay a one-time registration fee of R399 and a monthly subscription fee of R299. You must provide accurate profile information, including a photo, a description of services, and, if applicable, a 30-second video showcasing your skills.
Customers: Customers must create an account to browse and book services. All users must provide truthful information and maintain account security.

2.3 Prohibited Conduct:

You agree not to:

Use the Platform for illegal purposes or to violate any laws.
Post false, misleading, or offensive content.
Impersonate others or create fraudulent accounts.
Interfere with the Platform’s functionality or security.

2.4 Service Agreements: Grind & Grow facilitates connections but is not a party to agreements between Vendors and Customers. All service contracts are solely between the Vendor and Customer. Grind & Grow is not responsible for disputes, damages, or issues arising from these agreements.

3. Vendor Responsibilities

3.1 Service Quality: Vendors must provide high-quality, professional, and reliable services as advertised. Vendors are responsible for maintaining their reputation and building trust within the community.

3.2 Compliance: Vendors must hold all necessary licenses, permits, or certifications required for their services and comply with local laws.

3.3 Profile Accuracy: Vendors must keep their profiles up-to-date and accurate. Grind & Grow may remove profiles with misleading or incomplete information.

3.4 Payment: Vendors agree to pay the one-time registration fee (R399) and monthly subscription fee (R299) to maintain an active profile. Fees are non-refundable unless otherwise stated.

4. Customer Responsibilities

4.1 Booking and Payment: Customers agree to pay Vendors directly for services as per their agreement. Grind & Grow does not handle service payments unless specified.

4.2 Verification: Customers are encouraged to verify Vendor credentials before hiring. Grind & Grow does not guarantee the quality or outcome of services provided.

4.3 Conduct: Customers must communicate respectfully and provide accurate information when booking services.

5. Fees and Payments

5.1 Vendor Fees: Vendors pay a one-time registration fee of R399 and a recurring monthly subscription of R299 to maintain an active profile.

5.2 Payment Processing: Vendor subscription payments are processed securely through the Platform. Failure to pay fees may result in account suspension or termination.

5.3 Service Payments: Payments for services are handled directly between Vendors and Customers unless otherwise facilitated by Grind & Grow. We are not responsible for payment disputes.

6. Intellectual Property

6.1 Ownership: All content on the Platform, including logos, text, and designs, is owned by Grind & Grow or its licensors and protected by intellectual property laws.

6.2 User Content: By uploading content (e.g., photos, videos, descriptions), you grant Grind & Grow a non-exclusive, royalty-free license to use, display, and distribute it for Platform purposes.

6.3 Restrictions: You may not reproduce, modify, or distribute Platform content without prior written consent from Grind & Grow.

7. Privacy

7.1 Data Collection: We collect personal information (e.g., name, contact details, profile data) to operate the Platform. Please review our Privacy Policy for details on how we handle your data.

7.2 Data Sharing: User information is shared only as necessary to facilitate connections between Vendors and Customers or as required by law.

8. Liability and Disclaimers

8.1 No Warranty: The Platform is provided "as is" without warranties of any kind, express or implied. Grind & Grow does not guarantee the accuracy, reliability, or availability of the Platform.

8.2 Limitation of Liability: Grind & Grow is not liable for any direct, indirect, incidental, or consequential damages arising from Platform use, including disputes between Vendors and Customers.

8.3 Third-Party Services: Grind & Grow is not responsible for the conduct, performance, or quality of services provided by Vendors or third-party links on the Platform.

9. Termination

9.1 Account Termination: Grind & Grow may suspend or terminate your account for violating these Terms, including non-payment, fraudulent activity, or inappropriate conduct.

9.2 Effect of Termination: Upon termination, you lose access to the Platform, and any outstanding fees remain due. User content may be removed at Grind & Grow’s discretion.

10. Dispute Resolution

10.1 Governing Law: These Terms are governed by the laws of South Africa.

10.2 Resolution Process: Disputes between users should be resolved directly. Grind & Grow may assist in mediation but is not obligated to intervene. Any disputes with Grind & Grow shall be resolved through negotiation or, if necessary, in a South African court.
